Terms of service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Learn by Bits ("we," "us," or "our") website, services, and applications (collectively, the "Service"). By accessing or using the Service, you ("User" or "you") agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service Description

The Service allows users to study ready-made exam sets for free and, with a paid Study subscription, upload study materials that our AI processes into bite-sized concepts ("bits") stored in a database. Users can study these concepts, track predicted test scores, and manage their subscription. We reserve the right to modify, suspend, or discontinue the Service at any time without notice or liability.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account and Payment

To use the Service, you must follow these account and payment terms:

  • Account: You must create an account to save progress and use paid features. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
  • Free tier: Ready-made exam sets, cached questions, progress tracking, and predicted test score are free to study. No payment method is required for free use.
  • Study subscription: Study is a monthly subscription currently priced at $6.99/month. It unlocks AI features for your own material (uploads and generation, fresh uncached questions, free-text grading, explanation sessions, transcription, and related AI work). Each billing period includes a monthly AI allowance that resets on renewal; it does not accumulate. See our Pricing page for details.
  • Managing subscription: You can upgrade, manage payment methods, or cancel through the Stripe customer portal linked from your Account page. Cancellation takes effect at the end of the current paid period unless otherwise stated at checkout.
  • Legacy balances: Some accounts may retain a legacy AI balance from a prior billing model. Where present, that balance may fund AI features and does not auto-refill.
  • No Refunds: All payments are non-refundable, even if you discontinue use or encounter service interruptions, except where required by law.

5. User Content

You retain ownership of content you upload ("User Content"). By uploading, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, reproduce, and process User Content to provide and improve the Service. You represent that you have all rights to upload User Content and that it does not violate any laws or third-party rights.

6. Intellectual Property

We own all rights, title, and interest in the Service, including the AI-generated "bits," algorithms, and software. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

7. Acceptable Use

You agree not to:

  • Use the Service for illegal purposes or to upload harmful content (e.g., malware, obscene material).
  • Interfere with the Service’s operation (e.g., hacking, overloading).
  • Share your account credentials with others.
  • Upload content that you do not own or have full rights to upload.

We may suspend or terminate your access for violations at our sole discretion.

8. Termination

We may terminate or suspend your account at any time, with or without cause or notice, without liability. Upon termination, your access ceases, but we may retain your data as permitted by law or these Terms.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted access. We do not guarantee the accuracy of AI-generated content or the security of your data.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility. Our total liability is limited to the amount you paid us in the past 12 months.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or losses arising from your use of the Service, User Content, or violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by Utah law. Any disputes will be resolved through binding arbitration in Utah, except for small claims, with each party bearing its own costs. You waive any right to class actions.

13. Changes to Terms

We may modify these Terms at any time. Changes will be posted here, and continued use constitutes acceptance. Check back periodically.
